Abstract
Il reclutamento e la formazione dei magistrati nel Mezzogiorno cambiò radicalmente tra antico e nuovo regime. Durante il periodo spagnolo, quando il ceto forense assunse un ruolo dominante nell’assetto socio-istituzionale del Viceregno, la carriera in magistratura garantiva un’ascesa sociale in un percorso che partiva dall’esercizio dell’avvocatura e passava dalle cariche minori, che potevano essere acquistate, a quelle dei grandi tribunali a carattere temporaneo o perpetuo. Col decennio francese e soprattutto durante la Restaurazione si stabilirono regole precise per il reclutamento e la formazione con l’introduzione di prove e concorsi per la selezione degli aspiranti e il perfezionamento del sistema dell’Alunnato di giurisprudenza introdotto nel 1812 dal ministro Francesco Ricciardi. Il saggio si sofferma anche sulle norme che definivano e tutelavano la funzione giurisdizionale, oltre che sulla condizione dei magistrati nei diversi contesti istituzionali e politici.

The recruitment and training of magistrates in the Southern Italy underwent a profound transformation between the Ancien Régime and the modern era. During the Spanish period, when the legal profession came to occupy a dominant position within the socioinstitutional framework of the Viceroyalty, a judicial career offered a path of social advancement. This career typically began with the practice of law and progressed through minor judicial offices—which could be purchased—to appointments in the higher courts, whether for fixed terms or on a permanent basis. During the French Decade, and especially throughout the Restoration, clear rules governing the recruitment and training of magistrates were established through the introduction of examinations and competitive recruitment procedures for aspiring judges, together with the further development of the Alunnato di giurisprudenza (Legal Apprenticeship), first instituted in 1812 by Minister Francesco Ricciardi. The essay also examines the legal provisions defining and safeguarding the judicial function, as well as the status and role of magistrates within the different institutionaland political contexts.
